2. Description of Service

Book My Fiesta is an online marketplace that connects customers seeking party and event rental services with local vendors. We facilitate listings, quotes, and bookings but are not a party to any rental agreement between customers and vendors. We act solely as a platform to connect users.

3. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for safeguarding your password and for all activity under your account. You must be at least 16 years old to use this platform.

4. Vendor Responsibilities

• • Vendors must hold all required licenses, permits, and insurance for their services.
• • Vendors are responsible for fulfilling bookings and providing the services as described.
• • Vendors agree to pay applicable commission fees and membership fees as outlined in their plan.
• • Vendors must comply with all local, state, and federal laws and regulations.

5. Customer Responsibilities

• • Customers must provide accurate event details and payment information.
• • Customers are responsible for reviewing vendor listings before booking.
• • Customers agree to pay the full amount for confirmed bookings.
• • Customers must comply with vendor policies regarding delivery, setup, and usage.

6. Payments and Commissions

All payments are processed securely through Stripe. Book My Fiesta charges a commission on each booking based on the vendor's membership tier: 10% for Free, 8% for Pro, and 6% for Elite vendors. Membership and add-on subscription fees are billed monthly and are non-refundable unless otherwise stated.

7. Cancellations and Refunds

Cancellation and refund policies are determined by individual vendors and displayed on their listings. Book My Fiesta facilitates the payment process but is not responsible for vendor-specific refund decisions. Disputes should be resolved directly between the customer and vendor.

8. Prohibited Conduct

Users may not use the platform for any unlawful or fraudulent purpose, post false or misleading content, harass other users, or attempt to circumvent payment systems. Violations may result in account suspension or termination.

9. Limitation of Liability

Book My Fiesta is not liable for any damages arising from transactions between customers and vendors, the quality of vendor services, or any indirect, incidental, or consequential damages. Our platform is provided "as is" without warranties of any kind.

10. Intellectual Property

All content on this platform, including logos, text, graphics, and software, is the property of Book My Fiesta or its licensors and is protected by intellectual property laws. Users may not reproduce or distribute content without permission.

11. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion. Upon termination, your right to use the platform ceases immediately.

12. Changes to Terms

We may revise these Terms of Service at any time. Updates will be posted on this page with a revised "last updated" date. Continued use of the platform after changes constitutes acceptance of the new terms.
